Suspension of the execution of the resolution of the municipal council

In the article, the author focuses on institutes legislatively enabling the suspension of performance, respectively suspension of the implementation of the resolution adopted by the municipal council. The subject of the analysis are two legislative instruments. The first is the competence of the mayor to suspend the execution of the resolution adopted by the municipal council. The second option is the possibility of suspending the execution of the resolution on the basis of granting the suspensory effect granted to the administrative action in the matter of reviewing the legality of the resolution of the council under § 348 et seq. Administrative Judicial Code. In the context of these two tools, the author analyzes both institutes, having the same impact. When comparing their time and content determinants, it provides an insight into their real usability for the needs of the proper functioning of municipal self-government.
