The ecological release of water policy: hydrographic basin and its legal relevance

The planet comes at a decisive time when it is necessary to make firm decisions to conserve what remains of water on Earth. For this we understand that it is necessary to adopt more analytical positions based on systemic approaches in the context of complexity experienced in a hypercomplex society. To further problematize this scenario, Brazil has adopted a fragmented model of water policy. Thus, the present study intends to recover the legal importance of the expression “hydrographic basin” in the sense of starting to construct a concept of water security that can be crystallized in a legal norm. Thus, the deductive method was used, aided by the bibliographical and documentary survey of the jurisprudence. It was noticed that the Judiciary and the Public Ministry present moments of depth of analysis of problems related to the water policy in the country, however, it is necessary to further incorporate the idea of systemic analysis of problems involving water and environmental law, adopting the strategy to verify the impact on the river basins and to realize that water security does not only refer to the water available to humans.
