Mechanism of Administrative and Legal Regulation of the Prevention of Corruption in the National Police Bodies of Ukraine

The article analyzes the scientific positions of researchers and scientists regarding the understanding of the essence and content of the concept of “mechanism of administrative and legal regulation,” as well as its structure (elements). Administrative and legal regulation of corruption prevention in the bodies of the National Police is provided by a significant number of normative acts, which can be classified by legal force. Police officers, as participants in legal relations in the field of corruption prevention, can act both as subjects of responsibility and as subjects bringing to justice for violations of anti-corruption legislation. When outlining the system of legal regulation of social relations in the field of corruption prevention, he emphasizes that it is necessary to distinguish between acts of general action and acts of individual action. It is noted that the latter are: - personalized - they relate to the rights and obligations of individuals, i.e. they do not contain universally binding rules of conduct; - specific legal facts and give rise to, change or terminate specific legal relations related to the prevention of corruption, therefore they cannot be attributed to the system of legal regulation. Since “corruption prevention” involves the adoption of preventive, preventive measures and actions aimed at preventing the commission of corruption manifestations, and "anti-corruption" includes an arsenal of measures and actions used to identify and investigate already committed corruption offenses and bring guilty persons to the responsibility provided by law , we believe that for the clarity of the definition of the means used, it is expedient to distinguish between “mechanism of administrative and legal regulation of prevention of corruption” and “mechanism of administrative and legal regulation of combating corruption.” Investigating the specifics of combating corruption, the basic components of the mechanism of administrative and legal regulation are: administrative and legal norms, administrative legal relations and regulatory and procedural acts for the implementation of administrative norms.
