Przemoc domowa i dyskryminacja ze względu na płeć – Opuz przeciwko Turcji i inne

Description

Obecnie w dorobku strasburskim znajduje się wiele wyroków dotyczących przemocy wobec kobiet, w tym zwłaszcza przemocy domowej. Rozstrzygają one o odpowiedzialności państw-stron za niezapewnienie ochrony życia i zdrowia kobiet doświadczających przemocy, a w konsekwencji o naruszeniu zobowiązań wynikających m.in. z art. 2, 3, 6 czy 8 EKPC. Co więcej, począwszy od omówionego poniżej wyroku w sprawie Opuz przeciwko Turcji, ETPC postrzega przemoc domową nie tylko jako problem jednostkowy, wynikający z incydentalnych uchybień lub zaniedbań w danej sprawie, ale jako problem systemowy o dyskryminacyjnym charakterze, bo dotykający przede wszystkim kobiet
