Innovative Constitutional Foundations of the Basic Procedures for Ensuring Compliance and Restoration of the Legal Status of Sociosubjects

In the context of elucidating the essence and procedure of implementing the basic procedures for ensuring compliance with and restoring the legal status of citizens or other sociosubjects, special attention is assigned to the innovative essence and powers of the prosecutor's office, which has :

- to act according to the principle of unity of command and on one's own initiative by supervising the exact, uniform and consistent observance of legal acts by any persons and bodies, located on the territory of the state, including the president of the country, the parliament, the government, an ordistatour, an investigatetour, by the courts, the publictour, an advocacy, an executivetour and other antidelictal agencies, and the submission of an order to the offender or his direct or superior manager to immediately eliminate the reasons and conditions, that contributed to the commission of the offense, to stop the illegal act of any person and/or the effect of an illegal decision or legal act of subjects of power;

- restore the violated legal status of the victim as much as possible;

- initiate appropriate legal proceedings with the aim of inevitably bringing the person guilty of such a violation of the legal status of the victim to the appropriate type and nature and appropriate degree of severity of juridical responsibility and immediate elimination of the causes and conditions. that contributed to the commission of this offense;

- send materials to the publictour and advocacy for further support in this case of the interests of the victim and persecuted person, respectively.

Attention was drawn to the fact that the publictour and the advocacy in such a case should also function on the basis of the principle of unity and ensure the protection of the legal status in all types of legal proceedings of the victim and the offender, respectively, and the provision of other related legal assistance, receive wages and all other benefits only from the state.

A number of other innovative powers and constitutional foundations of the work procedure in this aspect of the court, the prosecutor's office and a number of other antidelictal agencies are also outlined.
