Obiectivele justiţiei în materie penală a Bosniei şi Herţegovinei în contextul punerii în aplicare a instituţiilor justiţiei tranziţionale ca factor al reconcilierii naţionale

Objectives of Criminal Justice in Bosnia and Herzegovina in the Context of the Implementation of Transitional Justice Institutions as a Factor of National Reconciliation
Transitional justice objectives in Bosnia and Herzegovina focus on both punitive and restorative justice. Referring to the criminal justice system implemented in Bosnia and Herzegovina in the post-conflict period, we note that this process took place in two ways - in the form of the International Criminal Tribunal for the former Yugoslavia and national, in the form of specialized territorial criminal tribunals. However, in the context of the objectives of transitional justice, territorial courts must also take into account the interests of victims, including their relatives, as well as witnesses to the atrocities committed during the active phase of the armed conflict in the Balkans in the mid-1990s.

Obiectivele justiţiei tranziţionale în Bosnia şi Herţegovina sunt axate atât pe justiţia punitivă, cât şi cea restaurativă. Referindu-ne la justiţia în materie penală implementată în Bosnia şi Herţegovina în perioada post-conflict, remarcăm, că acest proces a avut loc pe două căi - internaţională, în formula Tribunalului Penal Internaţional pentru fosta Iugoslavie şi naţională, în formula tribunalelor penale specializate teritoriale. Or, în contextul obiectivelor justiţiei tranziţionale, tribunalele teritoriale trebuie să i-a în consideraţie şi interesele victimelor, inclusiv a rudelor sale, precum şi a martorilor atrocităţilor comise în perioada fazei active a conflictului armat din Balcani la mijlocul anilor 90 ai secolului XX.
