THE EVOLUTION OF FRATERNITY AS A CONSTITUCIONAL LEGAL CATEGORY AND THE BRAZILIAN SUPREME COURT

Description

This paper is methodologically based on an extensive review of the available bibliography about the fraternity on different branches of knowledge: philosophy, law, sociology, political science and history. Also, this research aims to identify if there is real applicability of the fraternity principle on real cases. The interpretation of the Supremo Tribunal Federal on the following cases: embryonic stem cells for research and treatment of degenerative diseases; and the demarcations of Indigenous Lands (Raposa Serra do Sol). Therefore, the fraternity as an interpretational vector of the other principles of equality and liberty
