ІНФОРМАЦІЙНА БЕЗПЕКА У КОНТЕКСТІ ПРАВОВОГО РЕГУЛЮВАННЯ ЇЇ ЗАБЕЗПЕЧЕННЯ

Description

The rapid inclusion in the international information space, as well as the accelerated process of informatization, which is one of the characteristic features of modern Ukrainian society, carries both positive and negative trends, which requires the creation of a comprehensive system for ensuring information security, an integral part of which is the administrative- legal regulation of this sphere.

It has to be noted that today the term "information security" has a significant number of definitions both in legislative acts and in scientific literature due to the diverse views of scientists on this problem and, most importantly, the lack of a consolidated definition of "information security" in the legislative acts regulating the information the sphere.

Only now there are attempts to realize the depth of the problem that is called – "a person in the information society". First of all, in this context, it appears that the interests of a person in a particular area should primarily be aimed at guaranteeing and observing the constitutional human right to access information, the use of this information solely for the purpose not prohibited by law, for the spiritual and intellectual development of a person, and also the protection of information, in case of necessity to provide personal safety and security of the state.

The article is devoted to the investigation of the administrative and legal provision of information security, the urgent need of which, first of all, is the intensive development of the information society in Ukraine, as well as the rapid introduction of advanced information technologies in all spheres of society's life.

The analysis of the current legislation in the field of information shows that the essence of the concept of "information security" is largely confined to the concept of "information protection in information and telecommunication systems", although this concept reflects a purely technical component, presenting an interconnected set of organizational and engineering-technical measures, means and methods of information protection and in the scientific environment, and in the national legislation to date no consensus has been found regarding a clear understanding of the concept of "information security" that is born There is a twofold approach to the study of information security. So, in the context of national security, information security is seen as an independent element of it, as well as an element of any other security – economic, political, etc.
