The Law Of Kufu (Matchmaking): A Comparative Study Of The Talmud And Islamic Teachings

Description

The law of Kufu, a concept blended in both the Talmudic and Islamic traditions, has long been a subject of attention and debate among scholars. The aim of this comparative study is to explore the ramifications of the law of Kufu in the focused context of marriage, its interpretations and applications in both Talmudic and Islamic teachings. At its core, the law of Kufu concerns the principles of guardianship and the responsibilities that come with it, particularly marriage relationship. However, its implementation varies significantly between the two religious traditions, making it a complex and multifaceted issue. This study explores the contrasts and similarities between the Talmudic and Islamic interpretations of the law of Kufu. Despite sharing a common goal of ensuring the welfare and protection of vulnerable individuals, the two traditions exhibit distinct approaches to the application of the law, which reveal fundamental differences in their legal, ethical, and social frameworks of marriage, including all kinds of differences on the historical, cultural, and religious contexts that shaped these interpretations. This research work is qualitative in approach and based upon both primary and secondary sources e. g. Holy Quran, Sayings of Holy Prophet, Talmudic texts, Islamic jurisprudence, scholarly commentary from both traditions and articles. The study reveals a rich and complex landscape of legal and ethical thought, with both traditions offering unique insights into the principles and practices of martial relationship. The implementation of Islamic Sharia law of frugality aims to strengthen and stabilize interpersonal relationships by prioritizing health and kinship. However, customs, traditions, and regional ideologies have been incorporated into the law, leading to a negative view of relationships outside the family, nation, tribe, and region. This has resulted in unfair and incorrect application of the law, which has prioritized social norms over the well-being of the individuals.
