THE INFLUENCE OF CREATIVE COMMONS ON COPYRIGHT

The general objective of this work is to analyze the Creative Commons platform and its legal licenses 
as interference in copyright in the current digital age, in order to influence access to information and 
culture. To this end, a historical analysis of copyright, whether patrimonial or moral, will be carried 
out in order to shape what is now known as Author's Rights around the world, since there is, nowadays, 
the globalized instant connection . There is also an analysis of legal regulations as a way of protecting 
intellectual property under the aegis of Law 9.610 / 98 and its limitations in view of the availability of 
collections on the internet. Finally, a study is devoted to the Creative Commons platform, as well as its 
advantages and disadvantages due to the ease of distribution of works, analyzing it from the 
constitutional contexts of access to information and culture, essential to the evolution of society. The 
methodology used in this research is mostly bibliographic, with readings from articles, monographs 
and interdisciplinary legal doctrines, working in several areas of law. Copyright law raises several 
questions regarding its application today, since there are several works available, whether literary or 
audiovisual, without clear judicial control. Thus, it becomes an important study about its possibility of 
disseminating content and information and its limits regarding the application of the law of the creator, 
where the Creative Commons platform is the solution
