APLIKAČNÉ PROBLÉMY DVOJKOĽAJNÉHO POSTIHU EXTRÉMIZMU V KONTEXTE OCHRANY SLOBODY PREJAVU A V KONTEXTE SUBSIDIARITY TRESTNEJ REPRESIE

Článok sa zaoberá problematikou postihovania extrémizmu normami trestného práva a normami správneho práva, a to v kontexte ochrany slobody prejavu a v kontexte subsidiarity trestnej represie. Autorky v súvislosti s právom na slobodu prejavu poukazujú na prípady jej zneužitia, ktoré sú postihované ako nenávistné prejavy. V tejto súvislosti sa zaoberajú aj otázkou primeraného a spravodlivého sankcionovania páchateľa. Autorky ďalej na základe analýzy trestnoprávnej a administratívnoprávnej úpravy extrémizmu, ako aj na základe ich subsidiárneho vzťahu poukazujú na konkrétne aplikačné problémy, v dôsledku ktorých nedôjde k sankčnému postihu páchateľa extrémistického konania. Záverom formulujú konkrétne návrhy na odstránenie nedostatkov súčasnej právnej úpravy postihovania extrémizmu.

APPLICATION PROBLEMS OF DOUBLE TRACK OF EXTREMISM IN THE CONTEXT OF THE PROTECTION OF FREEDOM OF SPEECH AND IN THE CONTEXT OF SUBSIDIARY CRIMINAL REPRESSION

The article deals with the issue of punishing extremism by the norms of criminal law and norms of administrative law, in the context of the protection of freedom of expression and in the context of the subsidiarity of criminal repression. In connection with the right to freedom of speech, the authors point to cases of its abuse, which are punished as hate speech. In this context, they also deal with the issue of adequate and fair sanctioning of the offender. Furthermore, based on the analysis of the criminal and administrative regulation of extremism, as well as on the basis of their subsidiary relationship, the authors point out specific application problems, as a result of which the perpetrator of extremist act will not be penalized. In conclusion, they formulate concrete proposals to eliminate the shortcomings of the current legislation on the punishment of extremism.
