Cases contained on the documentary editorial in Algerian law

Abstract: The documentary editorial are the  papers the decision of  the contractors is fully established ,they are the subject of the legally prescribed forms  when they are issued either by a public  official  or an officer. To be recognized as official documents, the documentary  editorial must have the absolute  volumetric  either  between the contractors  or with other  people  because  they  are  considered as  an essential proof whack keeps the  contractors 'rights  legal and safe .in Addition, those documents could be a strong evidence inside the court because of the absolute  volumetric that  characterizes them and by  which the judge is restricted .But if those documentary editorial  lose some of their formality or subjectivity or if those documents are a subject of  counterfeiting , abrasion, jamming or if the editor document proved to be invalid because  some of their  conditions  are missing , the judge must intervene  thought an invitation brought  by one of  the litigants to reduce its value and to drop its official  capacity by signing the nullity or  proving the counterfeiting .

الدعاوي الواردة على المحررات التوثيقية في القانون الجزائري

الملخص: المحررات التوثيقية هي تلك الأوراق التي تفرغ  فيها إرادة المتعاقدين، وتخضع للأشكال المقررة  قانونا عند إصدارها من طرف شخص ذي صفة رسمية وهو موظف أو ضابط عمومي أو شخص مكلف بخدمة عامة، وهذا ليضفي عليها طابع الرسمية.            وهذه المحررات لها حجية مطلقة سواء بين المتعاقدين أو اتجاه الغير، فهي تعد ضمانة أساسية تحفظ بها الحقوق التي تتضمنها، لتعطي أمانا قانونيا للمتعاقدين. كما لها أهمية بالغة في الإثبات أمام القاضي، فحجيتها المطلقة تحدّ من سلطته وتجعله مقيدا بالأخذ بها، لكن متى فقدت هذه المحررات التوثيقية أحد الشروط الشكلية أو الموضوعية لإصدارها وتبين من مظهرها الخارجي ما يدل على التزوير كوجود كشط أو تحشير، أو أن المحرر باطلا لتخلف أحد شروطه، تدخل القاضي عن طريق دعوى يرفعها أحد الخصوم، للحدّ من قيمتها وإسقاط عنها صفة الرسمية، بتوقيع البطلان، أو إثبات التزوير.
