COMMENTS ON THE ANALYSIS OF THE SUBJECT OF SMUGGLING IN THE CRIMINAL LAWS OF SOME FOREIGN COUNTRIES

This article describes the analysis of the subject of smuggling in the criminal laws of some foreign countries. In particular, through this study, the norms of liability for smuggling in the criminal legislation of the Republics of the Russian Federation, Azerbaijan, Georgia, Armenia, Moldova, Tajikistan, Ukraine, Turkmenistan, Kazakhstan and Kyrgyzstan were analyzed in detail. In particular, attention is paid to the range of objects that are illegally transferred across the customs border in these countries and are recognized as the subject of the crime of smuggling. Through this study, it was determined that the scope of the subject of smuggling in these countries differs from the subjects defined in the criminal legislation of Uzbekistan. In this regard, the experience of each of the top foreign countries is compared with the national experience, and the positive experiences of the countries are highlighted. Reasonable proposals have been developed for introducing these positive experiences to Uzbekistan and improving the national criminal legislation. Systematic, logical (analysis, synthesis), comparative-legal analysis methods of scientific knowledge were used in the implementation of this research.
