The legal regulation of the Biometric Signature and its Authority as Evidence in Jordanian Legislation

Description

Abstract: The development of modern means of communication led to electronic dealing in various fields due to its ease and speed, where it was dispensed with conducting transactions in the traditional way of writing, in addition to the lack of the need for the parties to move and their presence in the same council to complete the transaction or contract. Accordingly, the traditional signature became incompatible with bonds and electronic transactions, and what is known as the electronic signature appeared, as it is considered more secure and private for customers, in addition to the speed and ease of its use.

التنظيم القانوني للتوقيع البيومتري وحجيته في الإثبات في التشريع الأردني

ملخص الدراسة:أدى تطور وسائل الاتصال الحديثة إلى التطور في وسائل إجراء المعاملات، حيث ظهر التعامل الإلكتروني والذي بناء عليه يتم إجراء المعاملات بالوسائل الإلكترونية، وذلك في مختلف المجالات، نظرا لسهولته وسرعته بالتالي توفير الوقت والجهد في أنجزت المعاملات، فقد تم الاستغناء فيه عن إجراء المعاملات بطريقة الكتابة التقليدية، كما أن من مميزاتها عدم الحاجة إلى انتقال الأطراف أو اجتماعهم أو تواجدهم في نفس المجلس لإتمام المعاملة أو العقد. وتبعا لذلك أصبح التوقيع التقليدي لا يلائم السندات والمعاملات الإلكترونية، ولذلك ظهر ما يعرف بالتوقيع الإلكتروني، والذي يعد أكثر أمنا وخصوصية للمتعاملين، بالإضافة إلى السرعة والسهولة في استعماله.
