Legal Considerations on the Protection of Submarine Cables in the International and National Legislative Framework
Description
This paper tackles the protection of submarine infrastructures, i.e. submarine cables, through the scope of international legal mechanisms. Military intervention and questions of jurisdiction under the law of the sea will be addressed. Further aspects of national criminal prosecution will also be touched upon. The paper argues, that the existing regime is far from adequate for the protection of submarine cables, especially in areas beyond national jurisdiction.
