THE LEGAL SITUATION OF FORMER GERMAN CULTURAL PROPERTIES
EXPROPRIATED AFTER WORLD WAR II 
This paper examines the legal situation of former German cultural properties which were confiscated by the Polish authorities after World War II. The author is of an opinion that the properties were confiscated in respect of war reparations. The Polish State has no duty of restitution or compensation. This was confirmed by the decision of European Court of Human Rights in the case of Franz Heuer v. Poland of 9 December 2008. Article 28 of the Treaty on Good Neighbourship and Friendly Cooperation cannot be interpreted as a binding norm strictly providing for restoration of former German properties.
