Tinjauan Yuridis Terhadap Transaksi Perbankan Melalui Internet Banking di Indonesia

This study aims at providing a juridical review of banking transactions through internet banking in Indonesia. The type of research conducted is normative juridical research. The nature of the research in this study is descriptive analytical. The type of data used inthis research is library research. Based on the results of the study, it was found that the settlement of legal protection disputes against bank transactions (customers) using internet banking services provided by the bank in terms of technology security was maximal and also fulfilled the aspects of confidentiality, integrity, authentication, availability, access control, and non-repudiation. Meanwhile, the most effective legal protection is that which is contained in the "internet banking terms and conditions", because these terms and conditions contain elements of the rights and obligations of the parties, especially the bank and the customer. Dispute settlement of legal issues that arise can be pursued through the courts or outside the court, based on the voluntary choice of the disputing parties. It is explained in Article 45 paragraph (1) of the Consumer Protection Law, that dispute resolution through the Court is said to be the authority of the General Court, while dispute resolution outside the court is the authorityof the Institution in charge of resolving consumer disputes. The legal regulation of banking transactions through internet banking is regulated in several laws and regulations, such as Law Number 10 of 1998 concerning banking, which stipulates and provides legal protection for customers' personal data in the implementation of internet banking services.
