LEGAL ASPECTS OF POLYAMORY
- 1. Universidade Estadual de Londrina (UEL)
Description
This text brings as its theme the legal aspects of polyamory. It exposes how changes in society and the plurality of types of relationships have brought hope to non-monogamous love arrangements. Polyamory as a lifestyle has become a way of choosing to form a family, demanding means for recognition of the union and legal support for these relationships. Therefore, the general objective of this work was to study the legal aspects present in polyamory and considered in Family Law in Brazil. The methodological survey procedures relied on a deductive method, with bibliographical research being carried out in different sources. Data analysis was qualitative, aiming at a more complete interpretation of the information. The research results showed that there is a legal gap regarding the family in a polyamorous relationship and that this affects different rights. It was concluded that the existing legal gap for this family brings legal uncertainty, when equality is a principle in treatment within plurality. Law needs to adapt to changes in new love arrangements to avoid injustice and damage to rights.
