THE SOCIAL FUNCTION OF INVESTIGATIVE JOURNALISM AND WHISTLEBLOWING

ABSTRACT

Seeking and bringing out the truth about potentially unlawful facts constitutes an interest worthy of attention, although often generally overlooked. The reason for this depends on the social utility obtained by seeking and publicly stating the truth; a utility that is by no means exhausted in the satisfaction of the interests of the individual aggrieved who attempts, by denouncing, to restore the harm suffered, but which is substantiated in an additional, systemic, collective benefit. In other words, this social utility is embodied in the complete and effective knowledge of the entire community around (at least) the most relevant unlawful facts. In this way, all citizens, adequately informed, can through voting determine their preferences in an informed way, orienting the correct political arrangement of the social structure; additionally, and secondarily, the judge is able to apply the law to the particular case, since (factual) truth is a prerequisite of it. The two subjects who are physiologically inclined to produce this positive externality are, on the one hand, the one who discloses the truth professionally, i.e. the investigative journalist, and, on the other hand, the one who has the opportunity to bring out the truth entirely occasionally, having learned of the existence of the wrongdoing only by chance and in the course of his or her duties, i.e. the so-called whistleblower. The primary objective of the research is to verify, from a critical perspective, the actual reasonableness of this premise, trying to demonstrate whether what has been argued about the existence of this public interest in the emergence of the truth can be said to be supportable. In the second instance, is to analyze the legal institutions that allow the pursuit of the interest in truth that modern society has. Various profiles of civil liability have been investigated, and, in the case of the investigative journalist, if his or her research, documentation and reporting of unlawful activities is unjustified, and in the case of the whistleblower, if he or she abuses the instrument of whistleblowing by reporting false facts. In the analysis on the civil liability of the investigative journalist, the legal tightness of the approaches reached by the most recent case law is deeply examined.

ABSTRACT

Far emergere la verità attorno a determinati fatti illeciti costituisce un interesse particolarmente meritevole di attenzione, ancorché spesso generalmente trascurato. La meritevolezza che sottende a questa attività di disvelamento del vero scaturisce dall’utilità che essa reca con sé; utilità che non si esaurisce affatto nel soddisfacimento degli interessi del singolo danneggiato che cerchi, denunciando, di ristorarsi del nocumento patito, ma che si sostanzia in un beneficio ulteriore, sistemico, collettivo. Nel senso anzidetto, tale utilità sociale si concreta nella completa ed effettiva conoscenza dell’intera comunità attorno (almeno) ai più rilevanti fatti illeciti, di modo che i cittadini, così adeguatamente informati, possano attraverso il voto determinare in modo informato le loro preferenze, orientando il corretto assetto politico della compagine sociale. I due soggetti che sono fisiologicamente più propensi a produrre questa esternalità positiva sono, da un lato, colui che disvela il vero professionalmente, ossia il giornalista d’inchiesta, e, dall’altro, colui che ha modo di far emergere la verità del tutto occasionalmente, avendo appreso dell’esistenza del fatto illecito solo casualmente e nell’espletamento della sua mansione, ossia il c.d. whistleblower. L’obiettivo primario della ricerca è dunque quello di verificare, in chiave critica, l’effettiva ragionevolezza di questa premessa, cercando di dimostrare se quanto sostenuto in merito alla sussistenza di questo interesse pubblico all’emersione della verità possa dirsi condivisibile, per poi analizzare gli istituti giuridici che permettono di perseguire il predetto interesse alla verità che possiede la società moderna. Si sono verificati i profili di responsabilità civile di cui possa rendersi responsabile sia il giornalista d’inchiesta, qualora la sua attività di ricerca, di documentazione e di denuncia di attività illecite risulti ingiustificata, sia il whistleblower, qualora abusi dello strumento della segnalazione, denunciando fatti falsi. Nell’analisi sulla responsabilità civile del giornalista d’inchiesta viene esaminata la tenuta giuridica delle impostazioni raggiunte dalla giurisprudenza più recente.
