ITSBAT NIKAH SEBUAH UPAYA MENDAPATKAN MENGAKUAN NEGARA (STUDI PENGADILAN AGAMA GARUT)

This article describes how to carry out Itbat Nikah in the Garut Inquisition as well as the obstacles and efforts to resolve the issue of Marriage Inquisition in the Garut Inquisition. And this research is related to Article 1(1)(1) of the 1974 Marriage Law which states that marriage is legal if it is carried out according to the laws of each religion and belief. And paragraph (2) states that all marriages must be recorded in accordance with the applicable laws and regulations. The purpose of this study is to explain how the marriage of bats in the Garut Inquisition was carried out, and to encourage efforts to resolve issues and issues related to bat marriage in the Garut Inquisition to find out. The research method used is a qualitative research type, and in this study the data collection technique was carried out by interviewing informants such as the judges of the Garut religious court, the deputy clerk of the Garut religious court, and the applicant. for his bat wedding. Based on the results of this study, it can be concluded that the Garut Inquisition Marriage Certificate is in accordance with the existing laws and regulations, but faces obstacles in its implementation. Education about the importance of registering marriages, and a strong understanding of those who believe that interfaith marriages are legal as long as they do not violate the Shari'a.
