The article reveals the legal status of a lawyer in civil proceedings. The lawyer as a qualified specialist has the right to provide legal assistance to citizens, to protect their violated rights, freedoms and legitimate interests.
The paper studies the elements of lawyers` conduct and attitude to the performance of their professional rights and responsibilities in order to provide proper, high-quality defending their clients. The study considers the concept of lawyer's secrecy and conditions of its preservation, as well as the range of powers of lawyers within the civil judicature.
Despite the opinion among people that having a contract with a lawyer is expensive nowadays, we emphasize the importance of the need to have a representative. Ensuring legal protection in the civil sphere requires a thorough study of existing case law, which can be useful in resolving civil disputes, better orientation in the field of civil law and its amendments, the ability to maintain legal secrecy.
The research analysed the role of lawyers in the field of civil judicature. Thus, they are representatives in the meetings: some work as the staff of certain institutions, organizations, etc., others are members of law firms, associations or carry out their activities individually. However, both have agreements to provide legal assistance to their clients. Representatives authorized to conduct a case in court shall exercise procedural rights and obligations, on behalf of the person they represent. Restrictions on the powers of the representative to perform a certain procedural action must be provided for in the power of attorney or warrant issued to them.
The article also focuses on the legal status of lawyers whose essence may differ in various forms of litigation, in the range of rights and responsibilities granted to them. In civil and administrative proceedings the lawyer is not tasked with delving too deeply into the trial, as mostly it is done in a written form on the basis of documents submitted by the parties (explanations, objections, evidence, etc).
