СТАНДАРТИ ЗАБЕЗПЕЧЕННЯ ПРАВ ЛЮДИНИ В ДІЯЛЬНОСТІ СЛУЖБИ БЕЗПЕКИ УКРАЇНИ В УМОВАХ ВОЄННОГО СТАНУ

Description

The article considers the categories «standard», «international standards of human rights». A group of international legal sources is analyzed, which declare human rights as the highest value of society and constitute the normative basis of the phenomenon. The importance of effective domestic implementation of the norms of international law in the field of protection of human rights and freedoms is emphasized. Based on the study of various theoretical and practical approaches, the author formulates the definition of international standards of human rights, indicating their role in modern international law and relevant national policy. Thus, the author proposes to understand international standards of human rights as such norms of modern international law, which provide for the obligation of states to enshrine in their legislation generally recognized norms for the protection of human rights, taking into account their geographical, political, and national characteristics of this or that country.

It is noted that the provision and affirmation of human rights and freedoms is the main duty of the state, because the vital interests of Ukraine include the real provision of the rights and freedoms of citizens and personal safety.

The legal position of the Security Service of Ukraine, as one of the state authorities in Ukraine, which carries out law enforcement activities, as well as the standards for ensuring human rights in conditions of martial law, is analyzed.

It is substantiated that in the conditions of martial law, the provision of human rights in the activities of the Security Service of Ukraine acquires special relevance. After all, the Security Service of Ukraine, as one of the state authorities in Ukraine, which carries out law enforcement activities, has as one of its key functions the support of law and order and security in society through the prevention, detection and investigation of offenses in the field of human rights protection.
