Plagio e diritto d'autore. Un'analisi comparata e interdisciplinare

Il plagio è un concetto affascinante e imprevedibile che fatica a trovare un proprio
spazio nella legge, mentre è oggetto di attenta analisi dottrinale e giurisprudenziale.
Sovente associato alla contraffazione e inteso come negazione di originalità e creatività,
il plagio può essere inquadrato nell’ambito del diritto morale d’autore, quale violazione
del diritto di paternità sull’opera dell’ingegno. Il volume analizza il plagio in questa
cornice prediligendo una metodologia interdisciplinare, che illustra le molteplici anime
del fenomeno nel naturale dialogo tra diritto d’autore e altri saperi, e comparata, grazie
al confronto tra il sistema giuridico italiano e quello britannico. L’approccio storico-
casistico, nell’esame di alcune selezionate pronunce dal 1891 a oggi, rivela interessanti
somiglianze e suggerisce altresì alcune ipotesi di riforma che meriterebbero di essere
considerate.
