Typical Investigative Situations at the Initial Stage of Investigating the Creation of Non-Statutory Paramilitary or Armed Formations

The article analyzes the concepts and classification of investigative situations that are formed at the initial stage of the investigation into the creation of non-statutory paramilitary or armed formations. An important place in the periodization of the investigation process is quite right belongs to the initial stage. The quality of investigation of the crime during this period depends on from the correct choice of the direction of investigation, forensic and procedural means and methods, the conducting of the necessary investigative (search) actions. Instead, errors at the initial stage, incorrect assessment of the investigative situation, and other gaps in investigative activities are highly likely to adversely affect the establishment of credible evidence in criminal proceedings. The practical significance of this question is that understanding the typical investigative situation helps the investigator to properly evaluate it and to plan directions for its resolution. In particular, the investigator can construct the most probable investigative versions, to establish the circumstances relevant to the criminal proceedings, to determine the scope and sequence of the investigative (search) actions and directions of further investigation.

It is noted that building effective recommendations in investigating a specified category of crimes is only possible considering the situational approach. This gives the opportunity to develop the most specific algorithm of actions of the investigator. It is proposed to use the information component as the criteria for typing investigative situations, namely the availability and nature of information about the main circumstances of the crime. According to each situation, the algorithm of the investigator's actions is developed, in particular, the procedural actions that need to be carried out in solving each typical investigative situation, their purpose and sequence of conducting are substantiated, and the means that are used to achieve a positive result are highlighted. Attention is drawn on the importance of carrying out the search measures aimed at establishing all the facts and circumstances of the crime
