Механізм адміністративно-правового регулювання малої приватизації в Україні: поняття, ознаки та зміст

Виконано порівняльний аналіз понять правових категорій "механізм правового регулювання" та "механізм адміністративно-правового регулювання". Встановлено існування статичної та динамічної концепцій цих правових категорій. Ідентифіковані ознаки механізму адміністративно-правового регулювання малої приватизації в Україні та сформульоване його авторське визначення як системи адміністративно-правових засобів у процесі їх використання уповноваженими особами для регулювання адміністративно-правових відносин у сфері малої приватизації для забезпечення її ефективності. Запропоновані зміни до чинного законодавства у сфері приватизації з метою нормативного закріплення поняття "механізм адміністративно-правового регулювання малої приватизації".

The concept of legal categories "mechanism of legal regulation" and "mechanism of administrative-legal regulation" is explored and disclosed. There are established two types of concepts of these legal categories: static and dynamic. A comparative analysis of the definitions of these concepts, developed by scientists within the framework of the static and dynamic concepts of the legal regulation mechanism, has been made, their features, content, and features in certain areas of implementation have been determined. Identified signs of the mechanism of administrative and legal regulation of small privatization in Ukraine: the content that forms the system of administrative and legal means, which in its interaction provides the process of legal regulation of small privatization in Ukraine; has a dynamic character, which is manifested in the process of the implementation of authorized actions by authorized persons within the legal framework; the goal is to streamline administrative and legal relations in the field of small privatization in order to ensure the effectiveness of the privatization process, to create a socially oriented market economy and to increase the socio-economic efficiency of production in Ukraine; the object of influence is the administrative-legal relations in the sphere of small privatization; operates on the principles of legality, openness and transparency, state regulation, control and responsibility. The mechanism of administrative-legal regulation of small privatization is suggested as a system of administrative and legal means in the process of their use by authorized persons for regulation on the principles of legality, openness, transparency, control and responsibility of administrative-legal relations in the field of small privatization for ensuring its effectiveness, creation of socially oriented a market economy and an increase in the level of socio-economic production in Ukraine. Proposed changes to the current legislation in the field of privatization with the purpose of regulating the concept of "the mechanism of administrative and legal regulation of small privatization".
