Imagens em Academias: Análise Jurídica Comparada

A divulgação não autorizada de imagens em academias de exercício físico, seja por alunos ou terceiros, levanta importantes questões jurídicas e éticas. Analisamos a responsabilidade civil, penal e subsidiária das academias e ou ginásios, na mesma forma como a obrigação de plataformas digitais, sob a perspectiva da Lei Geral de Proteção de Dados (LGPD), do Marco Civil da Internet, do Regulamento Geral de Proteção de Dados (RGPD) e de legislações específicas do direito comparado, Brasil e Portugal. Soma-se a esta análise a função dos profissionais de educação física e a nulidade de cláusulas genéricas dos contratos de adesão. Nesse sentido aplicou-se a metodologia explicativa e qualitativa para assim buscar consolidar o entendimento de qual é o posicionamento jurídico vigente e portanto responder objeto da pesquisa. Como resultado desta análise, foram consideradas as implicações éticas, legais e profissionais relevantes, de modo a garantir um posicionamento justo e alinhado aos ordenamentos jurídicos vigentes. A partir disso, foi possível estabelecer uma base teórica sólida para eventuais sustentações em tribunais, além de propor diretrizes valiosas e medidas preventivas capazes de mitigar práticas inadequadas, promovendo conformidade e integridade em todos os aspectos avaliados.
Abstract (English)
The unauthorized disclosure of images in physical exercise academies, whether by students or third parties, raises important legal and ethical issues. We analyze the civil, criminal and subsidiary liability of academies and/or gymnasiums, in the same way as the obligation of digital platforms, from the perspective of the General Data Protection Law (LGPD), the Internet Civil Framework, the General Data Protection Regulation (GDPR) and specific legislation of comparative law, Brazil and Portugal. Added to this analysis the function of physical education professionals and the nullity of generic clauses of membership contracts. In this sense, the explanatory and qualitative methodology was applied to seek to consolidate the understanding of what the current legal positioning is and therefore respond to the object of the research. As a result of this analysis, the relevant ethical, legal and professional implications were considered, in order to ensure a fair positioning aligned with current legal systems. From this, it was possible to establish a solid theoretical basis for possible arguments in courts, in addition to proposing valuable guidelines and preventive measures capable of mitigating inappropriate practices, promoting compliance and integrity in all aspects evaluated.
