Description

This study analyzes the principle of the best interest of the child from the perspective of the standards of the European Court of Human Rights. In accordance with the Court's jurisprudence, The child’s interest comprises two limbs: it dictates that the child’s ties with its family must be maintained and it is clearly also in the child’s interest to ensure its development in a sound environment, and a parent cannot be entitled to have such measures taken as would harm the child’s health and development. Thus, the Court takes this concept into account whenever it judges cases involving the interests of children, whether it is the ties between parents and children after their separation, adoptions, international child abductions, taking children from the family and entrusting them to the state authorities, etc.
