Особливості організації діяльності апарату Комісії з регулювання азартних ігор та лотерей

Постановка проблеми. Невід’ємною складовою ефективного функціонування Комісії з регулювання азартних ігор та лотерей є належне забезпечення її діяльності спеціально утвореним фаховим апаратом, правовий статус якого наразі виявляє певну неузгодженість та фрагментарність. Метою статті є аналіз правових засад організації діяльності апарату Комісії з регулювання азартних ігор та лотерей, визначення сутності та особливостей його правової природи та функціонально-структурної основи, а також обґрунтування напрямків удосконалення адміністративно-правового статусу апарату Комісії з регулювання азартних ігор та лотерей. Методи. Використано логіко-семантичний метод для розкриття ознак, сутності та змісту формально-правового статусу апарату Комісії з регулювання азартних ігор та лотерей; формально-юридичний – для з'ясування специфіки правового статусу керівника апарату Комісії з регулювання азартних ігор та лотерей, напрямків його роботи та повноважень; порівняльно-правовий та системно-структурний – для характеристики завдань, повноважень та структурної організації апарату Комісії з регулювання азартних ігор та лотерей, узагальнення особливостей та недоліків нинішньої організації його діяльності. Результат. Визначено, що апарат Комісії з регулювання азартних ігор та лотерей є її відособленим органом, що фахово й комплексно забезпечує виконання завдань та повноважень даного центрального органу виконавчої влади. Апарат Комісії з регулювання азартних ігор та лотерей поряд із всебічною забезпечувальною діяльністю здійснює окремі умовно самостійні владні повноваження, також направлені на забезпечення діяльності Комісії з регулювання азартних ігор та лотерей. Даний апарат має загальну компетенцію та нормативно невичерпні повноваження, діючи на постійній основі та формуючись на засадах державної служби. Також організація апарату характеризується здійсненням управління ним керівником апаратом за участі Голови та членів Комісії з регулювання азартних ігор та лотерей, організаційно-функціональною системністю значної кількості невеликих підрозділів апарату та його порівняно невеликим штатом. Висновки. Встановлено, що удосконалення організації діяльності апарату Комісії з регулювання азартних ігор та лотерей першочергово потребує уточнення його статусу, змісту та форм відносин із Комісією з регулювання азартних ігор та лотерей, конкретизації повноважень апарату, усунення з них дублюючих, невластивих і беззмістовних. Іншими заходами такого удосконалення мають бути врегулювання засад відповідальності та упорядкування управлінських повноважень керівника апарату, їх розмежування з повноваженнями Голови та членів Комісії з регулювання азартних ігор та лотерей, а також раціоналізація структурної організації апарату, забезпечення чіткої функціонально-предметної спеціалізації його підрозділів.

Problem statement. An integral component of the effective functioning of the Commission for the Regulation of Gambling and Lotteries is the proper provision of its activities by a specially formed professional apparatus, the legal status of which currently shows a certain inconsistency and fragmentation. The purpose of the article is to analyze the legal bases of the apparatus of the Commission for the Regulation of Gambling and Lotteries, to determine essence and peculiarities of its legal nature and functional-structural basis, as well as to substantiate the directions for improving the status of the apparatus of the Commission for the Regulation of Gambling and Lotteries. Methods. The logical-semantic method was used to disclose the signs, essence and content of the formal-legal status of the apparatus of the Commission for the Regulation of Gambling and Lotteries. The formal-legal method was used to clarify the specifics of the legal status of the head of the apparatus of the Commission for the Regulation of Gambling and Lotteries, his work areas and powers. The comparative-legal and systemic-structural methods were used to characterize the tasks, powers and structural organization of the apparatus of the Commission for the Regulation of Gambling and Lotteries, generalization of the features and shortcomings of the current organization of its activities. Result. It was determined that the apparatus of the Commission for the Regulation of Gambling and Lotteries is its separate body, which professionally and comprehensively ensures the fulfillment of the tasks and powers of this central body of executive power. The apparatus of the Commission for the Regulation of Gambling and Lotteries, along with comprehensive enforcement activities, carries out separate conditionally independent powers, also aimed at ensuring the activities of the Commission for the Regulation of Gambling and Lotteries. This apparatus has general competence and normatively inexhaustible powers, acting permanent and based on public service. In addition, the management of the apparatus is carried out by its head with the participation of the Chairman and members of the Commission for the Regulation of Gambling and Lotteries, the apparatus reveals the organizational and functional systematicity of a significant number of small units and relatively small staff of the apparatus. Conclusions. It’s established that improvement of the organization of the apparatus of the Commission for the Regulation of Gambling and Lotteries primarily requires clarification of its status, content and forms of relations with the Commission for the Regulation of Gambling and Lotteries, the specification of the authority of the apparatus, and the elimination of duplicative, uncharacteristic and meaningless ones from them. Other measures of such improvement should include regulating the responsibility and streamlining the management powers of the head of the apparatus, delimiting them from the powers of the Chairman and members of the Commission for the Regulation of Gambling and Lotteries, as well as rationalizing the structural organization of the apparatus, ensuring clear functional and subject specialization of its units.
