Alcance de las Garantías del Debido Proceso que debieran exigirse en el ámbito sancionatorio administrativo

El presente ensayo es producto del trabajo del grupo de reflexión sobre el debido proceso, organizado por la Academia Judicial1 y dirigido por el profesor Mauricio Ducce2 y la profesora Daniela Accatino3. En este trabajo se propone una incorporación conservadora de las garantías del debido proceso que debieran exigirse en el ámbito sancionatorio-administrativo, haciendo énfasis que no se puede hablar en rigor de “debido proceso” en este ámbito, sino del amparo de ciertas garantías que tienen sustento normativo constitucional y en los tratados de derechos humanos, y que debe exigirse en este ámbito, por tratarse de estándares básicos de respeto a la dignidad humana.

This essay is the product of the process of the thinking group on due process, organized by the Judicial Academy and directed by Professor Mauricio Ducce and Professor Daniela Accatino. This paper proposes a conservative incorporation of the guarantees of due process that should be required in the sanctioning-administrative sphere, emphasizing that it is not possible to speak strictly of “due process” in this area, but rather of the protection of certain guarantees that have constitutional normative support and in human rights treaties, and that must be required in this area, as they are basic standards of respect for human dignity.
