Administrative and Legal Mechanism for Regulating Labor Migration

The article is devoted to the analysis of the administrative and legal mechanism of labor migration regulation. Particular attention is paid to the coverage of labor migration in Ukraine, as well as the implementation of legal norms that take the form of compliance with prohibitions, performance of duties, application of rights and freedoms, and law enforcement. The administrative and legal regulation of migration processes and the classification of administrative and legal regimes are analyzed.

Labor migration is a major factor in the development of the national economy, which forms new socio-economic forms of labor, certain conditions, methods of state regulation of territorial and occupational mobility of labor, important principles of labor and socio-economic policy. Involvement of the national labor market in international cooperation, entry into the world labor market, various socio-economic reasons for the participating countries may lead to the possible need for in-depth study of the motives for labor migration, as well as the reasons hindering this process.

It is emphasized that international migration processes require regulation by states that take an active part in the change of labor resources. The age, social and professional composition of migrant workers, as well as the level of entry and exit of migrants are important for control and regulation. It is the functions of intrastate and interstate distribution of labor, regulation of the structure and volume of migratory resettlement that are largely performed by the Ministries of Labor, Interior, and specially created interstate and state bodies. An important role in legal regulation is played by the International Labor Organization (ILO), which aims to protect the rights of migrant workers. The ILO addresses an important issue - policy making and finding resources to manage labor migration. The administrative and legal mechanism for regulating labor migration is a set of rules governing labor relations in the process of migration entities, which are aimed at exercising the powers between the participants in these relations, in case of violation of which measures of state influence are applied.
