Essence, Basic Features and Differentiation between Deviant Behaviour, Compulsion and Violence

The article proves the essence of the individual’s deviant behavior and its division on not tortious and anti-social behavior which can be criminal and other anti-social deviant behavior of the individual. Attention has been focused on genetic addiction, disadvantages in education and on mental and other diseases of the individual as basic reasons of his/her deviant behavior. The essence and meaning of direct and indirect state compulsion in overcoming of the individual’s deviant behavior have been addressed. The essence of necessity, sufficiency, humanity, professionality and balance as basic legal features for the powers of the subject who deals with torts and other social subjects regarding overcoming of deviant behavior has been defined.

It has been underlined that deviant behavior of the individual is considered to be such behavior which is represented by systematical (three and more times) deviation of behavior from generally accepted norms. It is necessary to overcome anti-social deviant behavior of the individual which damages or can cause physical and/or material and/or primary and secondary moral damage and/or lost profit to the anti-social subject with deviant behavior and/or people around him/her and/or prevents or can prevent normal carrying out of the activity in which the person with deviant behavior is involved or related to.     

Special attention has been drawn to the fact that from the moment of discovering anti-social behavior the student of secondary school should be expelled from school which will create conditions for obtaining necessary school competences by other students of this school. Depending on the reason of anti-social behavior the person with deviant behavior should be placed in such conditions which should ensure that he/she will obtain necessary educational competences which is the responsibility of the President of Ukrainian and other state as a guarantor of compliance with legal status of all citizens.
