Derecho de los gobernados y disidencia moral en Foucault

Resumen: El objetivo de este artículo es realizar un análisis sobre la noción de “derecho de los gobernados” y su relación con la penalidad en la obra de Michel Foucault a partir de las intervenciones del filósofo en textos seleccionados del período 1973-1984. Se dejará en evidencia la perspectiva anti-humanista desde la cual Foucault comprende ambas cuestiones. Nuestra hipótesis indagará en si esta normatividad que el filósofo sostiene está fundada más en un afecto que en un modelo constructivista abstracto e investigaremos la convergencia de la defensa de la disidencia moral de Foucault con el anti-punitivismo de los autores neoliberales de los cuáles éste se sirve en Naissance de la biopolitique (Curso del Collège de France 1978-1979). Exploraremos la existencia de una premisa libertaria común que sustente la defensa de los derechos de los gobernados al mismo tiempo que rechace el punitivismo en materia de moralidad.

Abstract: The aim of this article is to carry out an analysis on the notion of “right of the governed” and its relation to punishment in Michel Foucault’s work from the philosopher’s interventions in selected texts from the period 1973-1984. The anti-humanist perspective will be made clear from which Foucault understands both questions. Our hypothesis will enquire if this necessary normativity that the philosopher sustains is based on an affection rather than on an abstract constructivist model and we will investigate the convergence of the defense of moral dissidence that it carries out with the anti-punitivism of the neoliberal authors of which Foucault is used in The Birth of Biopolitics (Lectures at the Collège de France 1978-1979). We will explore the existence of a common libertarian premise that supports the defense of the rights of the governed while rejecting punitivism in matters of morality.
