Authors/Creators

Description

This article examines the legal framework governing the extension of concession contracts in the context of public local transport services, in light of the judgment of the Regional Administrative Court (T.A.R.) of Lombardy – Milan, No. 32 of 2025, with particular focus on the relationship between European Union law and domestic legislation. The decision provides an opportunity to clarify the distinction between the two different grounds for contract extensions set out in Article 4(4) of Regulation (EC) No. 1370/2007 and Article 24(5-bis) of Decree-Law No. 4 of 2022, highlighting their respective requirements, purposes and scopes of application. In particular, the Court reiterates the exceptional nature of both mechanisms, emphasizing that an extension does not constitute an automatic right of the incumbent operator, but is subject to a technical and discretionary assessment by the competent authority, which must also take into account the general interest in market opening and the protection of competition. The ruling aligns with a consistent line of case law reaffirming the central role of public procurement procedures as the ordinary method for awarding public local transport services and limiting the use of contract extensions to narrowly defined circumstances.
