From Constitutional Rights to Institutional Protection: A Study of the Haryana Human Rights Commission

Authors/Creators

Description

India’s constitutional commitment to human dignity depends on institutions that can convert legal recognition into accessible protection. This article examines the philosophical foundations, statutory architecture, and oversight responsibilities of the Haryana Human Rights Commission within India’s federal rights framework. It adopts a qualitative documentary design combining normative analysis, doctrinal interpretation, and a bounded institutional case study. The Constitution, the Protection of Human Rights Act, selected judgments, international standards, and publicly accessible institutional materials provide the evidence. The analysis develops a rights realisation framework linking recognition, access, inquiry, remedy, and prevention. It identifies an important asymmetry between the Commission’s substantial powers to obtain information and its dependence on other institutions to deliver and verify corrective action. Formal independence consequently requires continuity of appointments, credible investigation, inclusive access, and transparent follow-up. The Haryana case also shows why complaint disposal cannot independently establish institutional effectiveness and why police-recorded crime cannot serve as a denominator for commission accessibility. The article proposes differentiated remedy tracking, conflict-sensitive investigation, accessible district outreach, and legislative scrutiny of implementation. It argues that state commissions should be evaluated as institutions connecting constitutional standards with administrative accountability, rather than through caseload alone. The findings concern institutional design and observable documentary arrangements; they do not establish causal effects on violations or measure complainant satisfaction.
