The Guarantee Fund in the event of revocation of an insurer's license – Issues regarding the application of subrogation under article 570z of the insurance code

This study examines the legal nature and scope of the guarantee protection provided by the Guarantee Fund in the event of an insurer having its license revoked. It analyzes subrogation under Article 570z of the Insurance Code and the scope of guaranteed claims (including interest and expenses), as well as the issue of recourse rights held by property insurers. Particular attention is paid to the period between the revocation of the license and the commencement of insolvency proceedings, and to the admissibility of individual legal actions and enforcement proceedings. Through systematic and teleological interpretation, proposals de lege ferenda are formulated to improve the legal framework and ensure effective protection for injured parties.
