Description
This report documents a series of judicial, administrative and enforcement proceedings in Latvia concerning the deprivation of property rights, denial of effective judicial protection, and the absence of an effective remedy prior to irreversible enforcement measures.
The materials include court submissions, judicial decisions, administrative correspondence, enforcement-related documents, and legal analysis concerning:
- Article 17 of the Charter of Fundamental Rights of the European Union (Right to Property);
- Article 41 of the Charter (Right to Good Administration);
- Article 47 of the Charter (Right to an Effective Remedy and Fair Trial);
- Article 6 of the European Convention on Human Rights;
- Article 13 of the European Convention on Human Rights;
- Article 1 of Protocol No. 1 to the Convention;
- Article 14 of the International Covenant on Civil and Political Rights.
The documentation raises questions concerning:
- access to justice;
- effectiveness of interim judicial protection;
- procedural fairness;
- execution of judicial decisions;
- protection against irreversible harm in property enforcement proceedings;
- compliance with the rule of law requirements established by EU law and the European Convention on Human Rights.
The collection is intended for researchers, legal practitioners, human rights institutions, journalists, EU institutions and international organizations interested in rule of law compliance and effective judicial protection within the European Union.
