A pragmatic conceptual approach for one, interoperable DSI ecosystem that is applicable across different UN fora and preserves the strength of free, open and unrestricted DSI data

Scientists, representatives from German national ministries, patent lawyers and legal experts came together to support the ongoing negotiations by offering constructive conceptual input and helping form the discussion. Three KEY MESSAGES emerged from the workshop:  

1. Explore attributing DSI as public good under the umbrella of Art. 15 CBD. This allows a conceptual shift to a fully decoupled but coherent, interoperable and flexible benefit-sharing in different UN fora following their own rules and benefit-sharing requirements. 

2. Creating a coherent global architecture for DSI that keeps the data open, free, unrestricted as digital public good can offer a data governance framework that sustains open data and the interoperability of database systems while ensuring interoperability of fair benefit sharing. 

3.  An interoperable approach under the umbrella of Art. 15 CBD decreases legal uncertainty, avoids obligations stacking and is suited to reflect the realities of DSI use.
