Description

Pesangon, uang penghargaan masa kerja, dan uang penggantian hak, dengan contoh terhitung

A foreign founder's worked-example handbook for calculating Indonesian termination payouts under the post-Cipta Kerja framework, where the multiplier depends on why the employee is leaving and the number on the cheque is almost never the number the statute prints.

Under the post-Cipta Kerja framework, Indonesian severance is no longer a single number — it is a small matrix where the multiplier shifts with the reason for separation, and the figure that actually changes hands is usually a negotiated point somewhere above the statutory floor; an operator who cannot rebuild the arithmetic from PP 35/2021 will sign whatever number is put in front of them, and the gap between that number and the floor is the price of not doing the math.

Audiences:

  • Foreign founder / expat GM facing first Indonesian payout — You just told your COO the role is redundant. HR slid a number across the table. You have no way to tell if it is the statutory floor, the lawyer's negotiating cushion, or a guess. The categories — pesangon, UPMK, UPH — are labels you have never had to reconcile against a multiplier in a regulation. You sign blind or you delay and bleed payroll.
  • Indonesian SME owner verifying a lawyer's number — Your kuasa hukum sent a calculation. It looks plausible. You suspect it is rounded up because the lawyer wants the matter closed without a PHI hearing. You cannot challenge the formula because you have never re-derived it. The employee's lawyer will not challenge either if it favours their client. You overpay by a month or two of payroll per termination, every time.
  • International M&A or restructuring advisor pricing termination cost — You are pricing a redundancy programme inside an Indonesian carve-out or a closure. The local labour counsel quotes a range. The range is wide because PP 35/2021 ties the multiplier to the reason for separation and the reason is partly the buyer's choice. Your deal model needs a defensible number, not a range. Without one, you misprice the deal or pad reserves and lose the bid.
