"OKUPACIÓN" ILEGAL DE INMUEBLES Y DERECHO PENAL: MARCO ESTADÍSTICO, DIMENSIÓN CONSTITUCIONAL Y APORTACIONES AL ANÁLISIS SUSTANTIVO PENAL

RESUMEN: En el presente trabajo, tras unas breves consideraciones terminológicas y conceptuales, se expondrán algunos datos sobre la realidad delictiva del comportamiento ocupacional, para dar paso a la necesaria dimensión constitucional del problema, principalmente centrada en la configuración del derecho a la inviolabilidad del domicilio y su reconocimiento o no a los eventuales ocupantes para finalizar con el núcleo del trabajo, centrado en la dimensión penal sustantiva del fenómeno ocupacional, donde detectaremos aspectos e interpretaciones generales de los delitos de allanamiento de morada o usurpación de bienes inmuebles para plantear y destacar su aplicabilidad (la de esos aspectos o interpretaciones) al específico fenómeno ocupacional, analizaremos el recorrido de las posibles alegaciones de estado de necesidad por parte de los ocupantes o de legítima defensa por los titulares legítimos que acometen un desalojo y concluiremos sobre la aplicabilidad o no al comportamiento ocupacional, en sí mismo, de otros tipos delictivos, más allá del allanamiento o la usurpación.

SUMMARY: In this paper, after some brief terminological and conceptual considerations, we will present some data on the criminal reality of occupational behaviour, to give way to the necessary constitutional dimension of the problem, mainly focused on the configuration of the right to the inviolability of the home and its recognition or not to the eventual occupants to end with the core of the work, focusing on the substantive criminal dimension of the occupational phenomenon, where we will detect general aspects and interpretations of the offences of breaking and entering or usurpation of real estate in order to raise and highlight their applicability (of these aspects or interpretations) to the specific occupational phenomenon, we will analyse the route of the possible allegations of state of necessity on the part of the occupants or of legitimate defence by the legitimate owners who undertake an eviction and we will conclude on the applicability or not to occupational behaviour, in itself, of other types of crime, beyond breaking and entering or usurpation.
