Description
The submitted paper analyzes the issue of domestic violence with a focus on the criminal offense of dangerous threats. It highlights the importance of a comprehensive assessment of factual circumstances, particularly the context of the relationship between the perpetrator and the victim, the intensity and repetition of the conduct, as well as its capacity to evoke reasonable fear in the victim. It examines the specifics of the evidentiary situation, which is largely determined by the absence of direct witnesses, a high level of latency, and frequent changes in the testimonies of injured parties. In this context, it emphasizes the need for the timely and procedurally correct securing of evidence. At the same time, the paper points to the importance of a professional and sensitive approach during the questioning of particularly vulnerable victims, as well as the necessity of effective coordination and cooperation between law enforcement authorities and other expert entities. In conclusion, it stresses the need for the systematic improvement of the professional preparedness of investigators and authorized police officers, along with enhancements in material and technical conditions, in order to increase the effectiveness of evidence-gathering and ensure adequate protection of victims.
