Personal and Financial Effects of the Marriage of Foreigners, and Its Dissolution by Divorce, Repudiation and Judicial Separation

The Syrian Conflict of Laws Rules are contained in the Syrian Civil Code from Article (12) to Article (24). 

If we examine these provisions collectively, they can be classified into several groups, each of which centers around a particular connecting factor that operates as the rule’s pivot, and this pivot differs from one group to another:

1. The group relating to matters concerning persons (Articles 12 to 18/1): the nationality of the persons concerned  appears as the central connecting factor in this group.

2. The group relating to property (Article 19): the situs (location) of the property occupies the position of central  connecting factor in this group.

3. The group relating to contracts (Article 20): the contractual will (the parties’ intention) predominates as the principal connecting criterion.

4. The group relating to form (Articles 18/2 and 21): the place of conclusion of the legal act necessarily appears as  one of the available connecting options.

5. The group relating to facts (Article 22): the place where the event occurred is the dominant connecting factor.

6. The group relating to procedural matters and evidence (Articles 23 and 24): the weight of connection is given to  the place of the court and the place where the evidence was prepared.

Below we provide a detailed explanation of all Syrian connecting rules in the order in which they appear in the Syrian Civil Code.
