THE BINDING FORCE OF JUDICIAL ACTS AND THE PROCEDURAL NATURE OF THE ENFORCEMENT STAGE, AND THE THEORETICAL-LEGAL MODEL OF MEDIATION IN THE ENFORCEMENT STAGE
Authors/Creators
Description
This thesis investigates the binding force of judicial acts, the procedural nature of the enforcement stage, and the theoretical-legal model of applying mediation in the enforcement stage. The relationship between res judicata and enforcement binding force, the procedural independence of the enforcement stage, and the balance between binding force and dispositivity are analyzed on the basis of comparative-legal methodology.
