الشركات التجارية، المحاضرة الأولى (مقدمة عامة)

The significance of companies is undeniable. As a pool of individual efforts and savings, they undertake major economic projects that exceed the capacity of any single individual, regardless of their capabilities. This has rendered them the ideal instrument for economic development. Furthermore, this importance has grown to the point where companies, particularly joint-stock companies, now enjoy an influence in all countries surpassed only by the authority of the State. They constitute a social and economic power whose might and dominance the State fears, prompting it to maintain close supervision to ensure they do not deviate from the proper path or become tools for social exploitation or political control.

أهمية  الشركات لا تنكر إذ أنها تضطلع، باعتبارها تجميعاً لجهد الأفراد ولمدخراتهم، بالمشروعات الاقتصادية الكبرى التي يعجز المرء بمفرده عن تحقيقها مهما بلغت قدراته وإمكانياته، مما جعلها الأداة المثلى للنهوض الاقتصادي. بل ولقد تعاظمت هذه الأهمية لدرجة أصبحت معها هذه الشركات، وبخاصة الشركات المساهمة، تتمتع في كل البلاد بسلطان لا يبرزه إلا سلطان الدولة، وتشكل قوة اجتماعية واقتصادية تخشى الدولة بأسها وسطوتها وترى من واجبها أن تسهر على رقابتها حتى لا تنحرف عن الطريق السوي وتصبح أداة للاستغلال الاجتماعي أو للسيطرة السياسية.
