الأركان الموضوعية الخاصة لعقد الشركة
Description
In addition to the aforementioned general substantive elements that must be present in a company contract, as in all other contracts, there are specific substantive elements peculiar to the company contract that distinguish it from other similar contracts. These elements consist of the plurality of partners, the contribution of shares (capital), the intention to associate (affectio societatis), and the sharing of profits and losses.
إلى جانب الأركان الموضوعية العامة السابق ذكرها والتي يجب أن تتوافر في عقد الشركة مثله في ذلك مثل كافة العقود الأخرى، هناك أركان موضوعية خاصة بعقد الشركة وهي التي تميزها عما قد يتشابه معها من العقود الأخرى، وتتمثل تلك الأركان في تعدد الشركاء وتقديم الحصص ونية المشاركة واقتسام الأرباح والخسائر.
