القانون التجاري 1 (الأعمال التجارية، التاجر، المتجر)

Commercial law is a branch of private law that applies to commercial transactions and regulates the trade profession. Thus, commercial law is the law that governs the relationships arising from certain transactions, namely commercial transactions. These transactions are often conducted between merchants or between merchants and their customers. Furthermore, commercial law regulates the activities of a specific category of persons, namely merchants.

Article 1 of the Syrian Commercial Law No. 33 of 2007 referred to this meaning, stating: "This Law contains, on one hand, the rules applicable to commercial acts performed by any person regardless of his legal status, and contains, on the other hand, the provisions applicable to persons who have adopted trade as a profession."

Legally, the term "commerce" encompasses a broader scope than it does economically. In the latter sense, it means everything related to the circulation and distribution of wealth. However, in the legal sense, commerce additionally includes industrial operations carried out by manufacturers relating to production, as well as financing operations carried out by banks. Thus, whoever practices industry as a profession, in the legal sense we will address in this regard, is none other than a merchant, meaning that commercial law applies to both commercial and industrial transactions simultaneously.

القانون التجاري هو أحد فروع القانون الخاص الذي يطبق على التصرفات التجارية وينظم حرفة التجارة. فالقانون التجاري هو القانون الذي ينظم العلاقات التي تنشأ نتيجة القيام بتصرفات معينة هي التصرفات التجارية، هذه التصرفات غالباً ما تتم بين تجار أو بينهم وبين عملائهم. كما أن القانون التجاري ينظم نشاط طائفة معينة من الأشخاص هي التجار.

وقد أشارت المادة الأولى من قانون التجارة السوري رقم 33 لسنة 2007 إلى هذا المعنى حيث نصت : " يتضمن هذا القانون من جهة القواعد المختصة بالأعمال التجارية التي يقوم بها أي شخص مهما كانت صفته القانونية ويتضمن من جهة أخرى الأحكام التي تطبق على الأشخاص الذين اتخذوا التجارة مهنة ".

وتشمل كلمة تجارة من الناحية القانونية نطاقاً أوسع منهم من الناحية الاقتصادية إذ يقصد من هذه الناحية الأخيرة كل ما يتعلق بتداول وتوزيع الثروات، أما من الناحية القانونية فتشمل التجارة علاوة على ذلك العمليات الصناعية التي يقوم بها الصناع وتتعلق بالإنتاج وعمليات التمويل التي تقوم بها البنوك، فمن يحترف الصناعة في المعنى القانوني الذي سنتناوله في هذا الخصوص ليس إلا تاجراً، بمعنى أن القانون التجاري يطبق على التصرفات التجارية والصناعية في الوقت ذاته.
