القانون الواجب التطبيق على الجانبين الموضوعي والشكلي للعقود "دراسة تحليلية في إطار نظام تنازع القوانين السوري"

Abstract

International contracts are considerable scope for the private international relations, and based on the importance of determining the laws applicable to the international contracts in both their substantive and formal aspects, this research addresses through a critical analytical study of the various relevant Syrian rules of laws conflict, in order to find out the positive advantages in the Syrian legislation on the one hand,  and to clarify the negatives on the other hand, with the aim of providing or establishing a legal basis for our proposal to redraft the legislative form of these rules in a way that ensure the protection of the judicial decisions from cassation because of a mistake in applying these rules, and in line - at the same time - with the requirements of the contractual relations within the private international law.

تعدّ العقود الدولية مجالاً رحباً للعلاقات الدولية الخاصة، وانطلاقاً من أهمية تحديد القوانين الواجبة التطبيق على العقود الدولية بجانبيها الموضوعي والشكلي يتصدى البحث من خلال دراسة تحليلية ناقدة لمختلف قواعد الإسناد السورية ذات الصلة ، وذلك للوقوف  على أهم ما يسجل لصالح المنحى التشريعي السوري في معرض ذلك الإسناد من جهة ، ولبيان أهم ما يؤخذ عليه من جهة أخرى ، وذلك بغرض تأسيس سند قانوني لمقترحنا بإعادة بناء الصيغة التشريعية لتلك القواعد بالقدر الذي يضمن حماية أحكام القضاء السوري مما سبق وتعرضت له من طعن محق بما آلت إليه خطأً في معرض تطبيق تلك القواعد ، وبما ينسجم –بنفس الوقت- مع احتياجات العلاقات العقدية في نطاق القانون الدولي الخاص.
