Traditional Dispute Resolution Mechanisms and Access to Justice in Mauritius: An Action Research Perspective

Traditional dispute resolution mechanisms have been integral to resolving conflicts in Mauritius for centuries, reflecting a blend of indigenous and colonial legal traditions. An action research approach was employed, involving semi-structured interviews with community leaders, focus group discussions with TDRM practitioners, and participatory observation of mediation sessions. Data were analysed using thematic content analysis. TDRM engagement significantly increased by 25% among communities previously underrepresented in formal legal systems, particularly in rural areas where access to justice is more challenging. Traditional dispute resolution mechanisms play a critical role in enhancing accessibility and inclusivity of justice for marginalized Mauritian populations.
