GAMING AND ONLINE GAMBLING REGULATIONS

India's gambling / online gambling regulations have oscillated with and since the period of the colonial era, Public Gambling Act,1867, to the recent Promotion and Regulation of online gaming Act,2025. This doctrinal analysis examines the conflict between the old distinctions between skill and chance and the federal rules today. The 2025 Act prohibits all online money games throughout the country and establishes a special authority to encourage e-sports gaming and social gaming. It suppresses earlier norms of self-regulation in the IT Rules, 2023. State laws continue to vary from Odisha's reduction of the penalty to fines on decriminalisation to outright bans in Tamil Nadu. These differences raise Article 254 concerns about the issue of jurisdiction in the federal system of India. Current issues include evasion by offshore players, linkage to the Prevention of Money Laundering Act (PMLA), and postponement of the ban on real money till January 2026. The paper recommends a single licensing regime that will follow RBI guidance, keeping in view federalism. Judicial orders demonstrate that the discussion is ongoing and that legislation needs to outline rules in order to secure consumer protection and digital sovereignty.
