Helechales conflictivos. Procesos de transformación de la responsabilidad sobre los bienes comunales en Navarra

La forma de aprovechar los bienes comunales en Goizueta (Navarra) desde hace siglos ha
consistido en cesiones de parcelas a los vecinos del pueblo para aprovechar el helecho, la castaña,
para construir bordas, chozas de pastor, etc. Estas cesiones gratuitas o Gracias, así como cesiones
posteriores a cambio de cuotas anuales, dieron lugar con el tiempo a un conflicto de doble
titularidad de la propiedad de esos terrenos, entre vecinos (titularidad privada) y ayuntamientos
(titularidad comunal), pues los particulares pudieron registrar esos terrenos en el Registro de la
Propiedad. A partir del estudio de este conflicto de larga duración, se analizan cuestiones como los
procesos desamortizadores del siglo XIX, los cambios en los regímenes de propiedad, las
dificultades para crear un Registro de la Propiedad “real”, la resolución planteada para el conflicto,
y el cambio en la responsabilidad y defensa de los bienes comunales, que pasó de estar en manos
de los vecinos del pueblo, a estar en manos del Ayuntamiento, y éste, estrechamente controlado
por el Gobierno de Navarra. En este contexto y tras resaltar la centralidad de los bienes comunales
en la política navarra, comenzamos a analizar las distintas concepciones de la propiedad que se
dan en Goizueta.

The form to take advantage of community lands in Goizueta (Navarre) has been for centuries the
cession of parcels to the neighbors of the village, in order to use ferns and chestnuts, to build
shepherd and cattle huts, etc. These free cessions or “Gracias”, as well as subsequent cessions in
exchange for annual quotas, gave rise in time to a conflict, based on the double ownership of these
lands, between neighbors (private ownership) and city councils (communal ownership), since
individuals were able to register these lands in the land registry. Through the study of this longterm
conflict, the following questions are analyzed: the disentailment processes of the nineteenth
century, the changes in the property regimes, the difficulty to create a Land Registry of undisputed
Property, the proposals to settle the conflict; and the change in the responsibility and defense of
the communal goods, which changed hands from the neighbors of the village to the town council,
closely controlled by the Government of Navarre. In this context (and after emphasizing the
centrality of communal goods in Navarre’s politics) we analyze the different concepts of property
that emerge in Goizueta.
