A dinâmica das vulnerabilidades: por uma reestruturação dogmática da vulnerabilidade contratual

Este estudo propõe uma reestruturação dogmática da vulnerabilidade contratual. Para tanto, partiu-se da análise do perfil estrutural da vulnerabilidade contratual, em busca da elucidação de seu conceito, traduzido na síntese ponderativa dos fatores vulnerantes averiguados in concreto. Tais fatores resumem-se nos seguintes dados extraíveis da factualidade: (i) restrição à liberdade de contratar stricto sensu; (ii) restrição à liberdade de escolher o contratante; (iii) restrição à possibilidade de o contratante negociar o conteúdo do contrato (ou adesividade contratual), (iv) dependência contratual. Por fim, empreendeu-se breve análise de como a vulnerabilidade contratual poderia auxiliar o intérprete no manejo dos mecanismos interventivos comumente utilizados no referido tipo.
Abstract (English)
This study proposes a dogmatic restructuring of contractual vulnerability. To achieve this, it began with an analysis of the structural profile of contractual vulnerability, aiming to clarify its concept, translated into the balanced synthesis of the identified detrimental factors examined in specific contexts. These factors can be summarized in the following data extractable from the factual circumstances: (i) restriction on the freedom to contract stricto sensu; (ii) limitation on the freedom to choose the contracting party; (iii) constraint on the contracting party's ability to negotiate the contract's content (or contractual adhesiveness); (iv) contractual dependence. Lastly, a brief analysis was undertaken on how contractual vulnerability could assist the interpreter in managing the intervention mechanisms commonly employed in the aforementioned type of situation.
